End User License Agreement (EULA) for Streets Online

Effective Date: April 30, 2025

BY INSTALLING, USING, OR ACCESSING THE GAME, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL, USE, OR ACCESS THE GAME.

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and MByte Development ("Developer," "we," "us," or "our") for the mobile game application Streets Online (the "Game").

1. License Grant

Subject to the terms of this EULA, Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Game for your personal, non-commercial entertainment purposes on a device that you own or control.

2. Restrictions

You agree not to:

• Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Game.
• Rent, lease, loan, sell, sublicense, distribute, or otherwise transfer the Game to any third party.
• Use the Game for any illegal or unauthorized purpose.
• Attempt to gain unauthorized access to the Game's servers or related systems.
• Use cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party software designed to modify or interfere with the Game experience.

3. User-Generated Content (UGC)

The Game may allow you to create, upload, post, send, receive, or store content, such as messages, usernames, profiles, or other materials ("User-Generated Content" or "UGC").

By using the Game, you explicitly agree to the following terms regarding UGC:

• Responsibility: You are solely responsible for your UGC and the consequences of posting or publishing it. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish the UGC you submit.
• No Tolerance for Objectionable Content: We have a zero-tolerance policy for objectionable content. You agree not to submit UGC that is:
  • Illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, pornographic, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
  • Constitutes unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
  • Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
• Content Moderation and Filtering: We employ methods to filter and moderate UGC submitted to the Game. These methods may include automated filtering systems and/or human review. However, we cannot guarantee that all objectionable content will be removed.
• Reporting Mechanism: The Game provides a mechanism for users to flag or report UGC they deem objectionable or users they believe are engaging in abusive behavior. Please use the designated reporting tools within the Game or contact us directly at [email protected] with the subject "Objectionable Content Report".
• Action on Reports: We commit to acting on reports of objectionable content or abusive users within 24 hours. This action will include reviewing the report and, if warranted, blocking the offending content. Repeated violations may result in account restrictions or termination.
• License to Developer: By submitting UGC, you grant Developer a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the UGC in connection with the Game and Developer's business.

4. Ownership

The Game, including all software, graphics, designs, and content (excluding UGC), is owned by Developer or its licensors and is protected by copyright and other intellectual property laws. All rights not expressly granted are reserved by Developer.

5. Termination

This EULA is effective until terminated by you or Developer. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Developer may terminate this EULA at any time without notice. Upon termination, you must cease all use of the Game and destroy all copies.

Developer reserves the right to terminate or suspend your access to the Game, without prior notice or liability, for any reason, including breach of this EULA or our Terms & Conditions, particularly for submitting objectionable content after previous warnings.

6. Disclaimer of Warranties

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. DEVELOPER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE GAME; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE GAME, INCLUDING UGC; OR (c) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

8. Governing Law

This EULA shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles.

9. Changes to EULA

Developer reserves the right to modify this EULA at any time. We will notify you of significant changes by posting the new EULA within the Game or via other communication methods. Your continued use of the Game after such modifications constitutes your acceptance of the revised EULA.
